The Seanad has scheduled motions to approve seven separate sets of exempted development regulations and new outdoor event licensing rules without debate.
During the Order of Business on 16 July 2026, Senator Garret Ahearn outlined the scheduling of several legislative motions returning from committee. The scheduled items include:
- Motions regarding the Planning and Development (Exempted Development (Act of 2000)) Regulations 2026, spanning seven distinct measures from the primary regulations through to the "(No. 7)" regulations.
- A motion regarding the Planning and Development (Licensing of Outdoor Events) Regulations 2026.
- A motion regarding the Civil Law (Miscellaneous Provisions) Act 2022 (Section 9(2)) (Amount of Financial Contribution) Order 2025 (Revocation) Order 2026.
All nine of these planning-related motions were scheduled to be taken sequentially without debate upon the conclusion of the Order of Business.
Parliamentary Oversight Questioned
The decision to process the regulations without debate drew immediate criticism in the upper house. Senator Michael McDowell questioned whether the chamber was exercising genuine oversight, noting that under the planning legislative scheme, exempted development proposals must be considered by both Houses.
Senator McDowell highlighted that the regulations had been sent to a committee and reported back without the main chamber knowing what the committee made of them, raising concerns over whether the Seanad had adequately considered the measures.
