Rural housing eligibility
Who can build a house in the Cavan countryside?
In Cavan, rural housing is permitted for individuals with a genuine 'rural generated' social or economic need to live in the countryside, such as local community members, returning emigrants, and local workers. In Areas under Strong Urban Influence, housing is restricted to landowners (defined as holding a minimum of 10 hectares) and their immediate families, while other rural areas facilitate broader local needs. Urban-generated housing is systematically directed to nearby towns and villages.
Who may qualify
Intrinsic part of the rural community(Page 417, Section 12.13.2)
Persons who have a strong social or economic need to live in the area, or currently reside in the local rural area and can demonstrate a social/economic requirement for permanent residence, provided it is their first home in the locality.
Returning emigrants(Page 417, Section 12.13.2)
Those who lived for substantial parts of their lives in rural areas, moved abroad, and now wish to return to reside near other family members, to work locally, to care for elderly family members, or to retire.
Care and support needs(Page 417, Section 12.13.2)
Persons who need to reside near elderly parents to provide security, support, and care, or elderly people who need to reside near immediate family.
Working locally(Page 417 & Page 418, Section 12.13.2)
Persons working full-time or part-time in farming, forestry, or other agricultural-related occupations; those whose work is intrinsically linked to or predominantly takes place within rural areas; or persons employed locally whose employment provides a service to the local community.
Landowners / Family landholding(Page 418 & Page 419, Section 12.13.2)
In Areas under Strong Urban Influence, individuals with a land holding of a minimum of 10 hectares (defined as landowners) and their immediate family members with a demonstrable social or economic need. Applicants not meeting the 10-hectare ownership threshold are dealt with on a case-by-case basis.
Rules by rural area type
The county is split into area types with different rules.
Areas under Strong Urban Influence
Development is restricted to landowners (minimum 10 hectares) and their immediate family members with a demonstrable social or economic need. An occupancy clause of a minimum of 7 years applies. Urban-generated housing needs must be accommodated in adjoining towns and villages.
Stronger Rural Areas
Accommodates rural-generated, social, or economic housing needs subject to good planning practice. Urban-generated housing is directed to towns and villages, and a minimum 7-year occupancy condition is applied.
Structurally Weak Areas
Aims to accommodate any demand for permanent residential development as it arises, subject to good planning practice, siting, design, access, wastewater disposal, and environmental protection.
Conditions attached
- Occupancy condition/clause of a minimum of 7 years (RH 06, SUI 03, SRA 02)
- The dwelling must be the applicant's first home in the locality
- Applications must be for individual dwelling houses only and made in the name of the person who is the intended occupier (RH 05)
- All applicants must complete a 'Rural Housing Application' form to ascertain and monitor housing needs (RH 04)
Who typically does not qualify
- Urban generated housing applicants (persons living and working in urban areas seeking housing in rural locations)
- Applicants in Areas under Strong Urban Influence who do not meet the minimum 10-hectare land ownership threshold, unless approved on a case-by-case basis
- Those who cannot demonstrate a local social or economic requirement to reside permanently in the area
