Government Outlines Planning Judicial Review Fee Scale and Critical Infrastructure Fast-Track Mechanism
Thursday 5 November 2026
A scale of fees for environmental judicial reviews and fast-track planning designations have been outlined as key delivery reforms alongside major housing infrastructure allocations.
Government planning reforms include a scale of fees for environmental judicial reviews and fast-tracked approvals for designated critical infrastructure projects.
Speaking during Dáil questions on Cabinet committees, the Taoiseach set out details of delivery reforms alongside capital allocations under the revised National Development Plan, which commits over €275 billion to critical infrastructure through 2035.
Judicial Review Costs and Infrastructure Designations
Addressing project delivery bottlenecks, the Taoiseach confirmed the introduction of a scale of fees for environmental judicial review proceedings. The measure aims to establish a clearer cost structure for applicants, prevent unpredictable expenditure for the State, and curb prolonged delays affecting public infrastructure schemes.
Under regulatory changes, strategically significant developments can now be formally designated as critical infrastructure to accelerate their progress through planning approval mechanisms. The Galway City Ring Road was designated under this critical infrastructure process in July.
Housing and Water Infrastructure Funding
Infrastructure funding directly tied to residential development includes 82 projects being backed through the €1 billion Housing Infrastructure Investment Fund. Overseen by the Housing Activation Office, these schemes are intended to unlock delivery of 86,000 homes by addressing site-servicing deficits.
Water and wastewater capacity will receive €2.35 billion under the 2027 allocation for Uisce Éireann, supporting more than 400 capital projects. Priority schemes progressing next year include:
- The Eastern and Midlands Region Water Supply Project
- The Greater Dublin Drainage Scheme
- Wastewater treatment plant upgrades across counties Limerick and Waterford
Capital commitments also cover transport schemes, with €6 billion allocated to MetroLink across 2027–2030 as tendering advances and early onsite enabling works begin. In local road development, surveys have commenced on the Kilkenny northern ring road extension to support planned expansion and new residential zoning on the north side of the city.
