The High Court has dismissed an appeal by a developer, upholding orders to remove 29 unauthorised homes in south County Dublin within six weeks.
The High Court has ordered the removal of 29 houses built without planning permission on a site in south County Dublin.
The ruling came after a developer and the owners of the sensitive site lost their appeal against enforcement orders. The judgment directs that the unauthorised structures must be removed within six weeks, and the respondents must submit a detailed draft remediation and landscaping plan to restore the site.
South Dublin County Council and a local resident, John O'Neill, pursued the enforcement case, arguing that the works were entirely unauthorised and that the site should be returned to its original state.
During the legal proceedings, the disputed works were determined to be completely new structures rather than refurbishments. The court found that the building works amounted to a serious redevelopment and transformation of the south Dublin site without the required planning permission.
