(1) construction of 3 no. Dwelling units within the previously approved 40-unit housing development under reg. Ref. No. 24/60591 comprising a two storey terrace of 3 no. Dwelling houses forming an extension to the permitted b block, which consists of a two storey duplex apartment block with the existing unit forming an end gable. Access to the rear gardens will be provided via a 1,200mm wide external rear footpath from either side of the block and the proposed development will utilise the internal road network and all associated site development works permitted under reg. Ref. No. 24/60591 and (2) removal and/or variation of condition no. 2 of the parent permission for the provision of a bicycle and pedestrian footpath. It is proposed that this requirement be addressed by way of a special development contribution under section 48(2)(c) of the planning and development act 2000 (as amended), or alternatively by the plannning authority/local authority, with a financial contribution to be made by the developer in lieu of the works
